Limited Warranty
Tides Marine warrants the products that it manufactures to the original purchaser of the products ("Buyer") to be free from defects in material or workmanship
for a period of two years from the date of initial sale or 2500 engine hours (whichever comes first). This limited warranty does not apply to any product that has been:
(i) repaired or
altered without Tides Marine's consent,
(ii) used for purposes other than those for which it was intended,
(iii) subjected to misuse, improperly installed or maintained or
(iv) damaged
by accident or negligence.
THE LIMITED WARRANTY MADE HEREIN IS MADE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND THERE ARE NO OTHER WARRANTIES THAT EXTEND BEYOND THIS EXPRESS LIMITED WARRANTY.
If Buyer believes a product to be defective, Buyer should contact Tides Marine to obtain a warranty return authorization number and should return such product to Tides Marine with reference to such number, freight prepaid. If Buyer makes a claim under this limited warranty within the specified period and it is subsequently determined by Tides Marine that a product is defective, the product will be replaced or repaired at Tides Marine's option. If such product cannot be repaired or replaced, Tides Marine will refund the sale price of the product to Buyer. This is Buyer's sole remedy for defective products. Tides Marine's liability under this limited warranty will be limited solely, at Tides Marine's option, to either the repair or replacement of a defective product or a refund of its sale price. TO THE FULLEST EXTENT ALLOWED BY LAW, TIDES MARINE WILL NOT BE LIABLE TO BUYER OR TO ANY OTHER PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR INDIRECT DAMAGES, LOST PROFITS OR OTHER LOSSES OF BUYER OR ANY OTHER PARTY ARISING OUT OF OR IN ANY WAY RELATING TO ANY TIDES MARINE PRODUCT.
SPECIAL NOTE FOR PDQ MV34: Tides Marine Shaft Seal Assemblies may be installed at the owners discretion, but will be supplied WITHOUT Warranty.
NOTE: Tides Marine SureSeals are NOT recommended for use with engines with less than 4 cylinders. The Tides Marine Series-One Shaft Seal should be used with 1, 2 and 3 Cylinder Engines
Some jurisdictions do not allow the (i) exclusion of implied warranties and whenever implied warranties are not allowed to be excluded in their entirety, they will be limited to the period of the express written warranty contained herein and (ii) the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This limited warranty:
(i) gives you specific legal rights and you may also have other rights which vary from state to state and
(ii) shall be governed by the laws of the
State of Florida, without reference to conflicts of laws principles and expressly excluding the application of the United Nations Conventions on Contracts for the International Sale of
Goods. Any action or proceeding arising out of or relating to this limited warranty will be held in the United States District Court for the Southern District of Florida or the
applicable state court in the State of Florida, County of Broward.
